Phillips P. O'Shaughnessy, P.A. concentrates its practice in claims of professional negligence, business torts and medical malpractice in Florida, and will consider representation of parties in legal malpractice and medical malpractice cases in Maryland, Washington, D.C. and New York.

Our history and current practice includes the representation of individuals, technology companies, and academic institutions against attorneys for legal malpractice. In one case, resolved during the year 2000, we represented a major United States Medical School and its technology arm against national law firms for negligence in the prosecution of a US patent for the discovery of a key DNA sequence in the battle against cancer, as initially reported by The Legal Times of Washington, D.C. (Week of May 4, 1998) In an earlier litigation, we demonstrated to the jury over the course of a three-month trial, that a local Baltimore based law firm, destroyed the ownership rights in a valuable data technology company, as reported in 96 Lawyers Weekly USA 703 (1996). Our most recent business tort trial (June 2004) involved the prosecution of civil claims by an ousted business owner for breach of fiduciary duties and civil conspiracy against the remaining business owner and the company's dominant supplier. The jury returned a verdict exactly to the penny on the amount of damages we recommended to it for their consideration. Currently we are representing an individual and his entrepreneurial company against a national health service provider of skilled nursing facilities for business torts in depriving him and his company of substantial finders fees in a variety of transactions.

We have successfully represented individuals against health care providers in cases of delayed diagnoses of cancers, surgical errors, hospital errors, and pathological negligence. Our recent resolutions include claims against a family physician for failure to timely diagnose fully treatable lung cancer and a claim against a Maryland based hospital for its failures to implement its own fall prevention protocols for an at risk patient who, we alleged, suffered a fall directly leading to his death while at that hospital.

Our attorneys' appellate successes include the adoption by the Maryland Court of Special Appeals of the federal rule standards for the grant or denial of summary judgment motion practice. Part of our practice includes representation of former officers and directors in class action and shareholder derivative suits and in pursuing their interests in retirement and stock option programs against the corporations that they once served.
